JUDGMENT S.S. Saron, J.(Oral):- Learned counsel for the parties have been heard. 2. This order will dispose of the above five Criminal Miscellaneous petitions as they arise out of the same F.I.R. No.273, dated 13.10.2006 registered at Police Station Sadar Muktsar in respect of the offences under Sections 364, 365, 366, 367, 368, 341, 494, 497, 498, 109, 34 and 120-B IPC. 3. F.I.R. has been registered on the statement of Gurdas Singh who stated that on 11.10.2006, he was married to Kuldeep Kaur (Petitioner in Criminal Misc. No.4190-M of 2007). Besides other dowry articles, one Maruti Car was given to him in dowry. The marriage of his brother-in-law, namely, Tarsem Singh (i.e. brother of Kuldeep Kaur) was fixed on the date of the occurrence (i.e. 13.10.2006). The complainant along with Kuldeep Kaur and son of his maternal uncle Sukhwant Singh son of Sadhu Singh had gone to attend the marriage. After marriage his brother-in-law, he alongwith his wife Kuldeep Kaur and son of his maternal uncle Sukhwant Singh were returning. Sukhwant Singh was driving the car and they were sitting on the rear seat of the car. They were returning from Village Gaddadob to Village Bhagsar. It was about 8.30 p.m. that they reached Village Chibranwali which is one and half kms. ahead of Village Khunan. At that time, one car was parked on the passage near the canal minor. The driver of the said car on seeing the car of the complainant gave a signal with his light. The complainant’s car crossed the other car. Thereafter, the person sitting in the car behind the car of the complainant crossed the complainant’s car and stopped their car in front of the complainant’s car. Sukhwant Singh, who was driving complainant’s car, also stopped the car. Two persons alighted from the other car whose identity has been mentioned. They started beating the complainant. The complainant Gurdas Singh got out of the car and ran towards the fields and one of the persons who was wearing white clothes followed him. The complainant took out his gold chain, Kara, ring weighing about 4 tolas and his purse containing Rs.2,000/- and threw them in the bushes. The complainant then came to know that the car borne persons in the other car, who were 3-4 in number, had abducted his wife and also Sukhwant Singh, the son of his maternal uncle in their car.

His wife was wearing gold ornaments. She also had some money that had been received as ‘Shagun’. They left the complainant’s car and luggage, suit-case lying there at the spot. The complainant received minor injuries on left elbow while running from the car. The persons in the other car had kidnapped the wife of the complainant and the son of his maternal uncle. After running away from the place of occurrence the complainant informed in his village and his relatives on mobile phone. Thereafter his statement was recorded. 4. During the course of investigation it was found that the entire occurrence had been stage managed by Kuldeep Kaur (petitioner), wife of the complainant in connivance with her paramour Dalwinder Singh alias Doctor (petitioner in Criminal Misc. No.4191-M of 2007). Accordingly, Kuldeep Kaur and Dalwinder Singh alias Doctor were arrested. The statement of Sukhwant Singh was recorded under Section 161 Cr.P.C. on 13.10.2006. After giving my thoughtful consideration to the matter and perusing the record, it may be noticed that the question whether Kuldeep Kaur and Dalwinder Singh @ Doctor had indeed stage managed the entire occurrence is to be gone into and determined during the trial in the case. The petitioners have a different story that Kuldeep Kaur refused to accompany her husband but her husband and her relative Sukhwant Singh forcibly took her to their village. In this manner, she came to know about the conspiracy that they were going to kill her. It is stated that she was forcibly taken to the field and she managed to escape by taking a lift. The challan in the case has been filed and the trial in the case would take some time. The accused other than Kuldeep Kaur and Dalwinder Singh @ Doctor have not been named in the FIR and the role attributed to each of them is to be considered and gone into after the trial of the case. It may also be noticed that Pritam Singh @ Babli (Petitioner in Crl. Misc. No.80852-M of 2006) and Kulwant Singh and another (Petitioners in Crl. Misc. No.1413-M of 2007) have been admitted to bail by this Court vide order dated 06.02.2007.

In the circumstances, without going into the merits of the case, lest it may prejudice the case of either side, the petitioners on their furnishing personal bonds and surety each to the satisfaction of the Chief Judicial Magistrate, Muktsar shall be admitted to bail. All the Criminal Misc. petitions stand disposed of accordingly. —————————————
