SANJAY KISHAN KAUL, J. ( 1 ) A suit for declaration, cancellation of mutation and conveyance deed in respect of the property bearing no. D-II/44, Lajpat Nagar-II, New Delhi has been filed by the plaintiff. The plaintiff is the son of defendant no. 1 who is his mother. Defendant nos 2, 3 and 4 are the paternal uncles of the plaintiff while defendant no. 5 is the Landdo. The property in question was converted into freehold vide conveyance deed dated 16. 07. 2002 in terms whereof defendant nos 1 to 4 became the co-owners of the property. The property measures 200 square yards. ( 2 ) WRITTEN statements were filed by all the defendants. The relevant aspect of the written statement of defendant nos 2 and 3 is that the property of 200 square yards was divided by metes and bounds into two portions whereby defendant no. 1 and defendant no. 4 became owners of 100 square yards of the land which was marked as D II/44 B, Lajpat Nagar II, New Delh. ( 3 ) THE matter was sent to the Delhi High Court Mediation and Conciliation Centre and apparently a settlement was arrived at in terms whereof it was agreed that the property falling to the share of defendant nos 1 and 4 would be sold and 15 per cent of the sale proceeds would be given to the plaintiff. However the settlement was not finally signed. ( 4 ) IT is stated that the plaintiff wants to continue to utilize the 12. 5 square yards of property in his own right which right was accepted by defendant nos 1 and 4. Insofar as 2. 5 square yards of land is concerned, defendant nos 1 and 4 were willing to give the price for the same in case the property was sold. A modified proposal was discussed by the parties and proposed in Court whereby the plaintiff agrees to buy this 2. 5 square yards of land so that he would obtain title of 15 square yards of land by paying consideration for 2. 5 square yards. The consideration has been agreed to as Rs 7. 5 lakhs to be paid within three months by the plaintiff. ( 5 ) THE plaintiff has also agreed to surrender possession of the remaining portion of the property to defendant no.

A site plan has been filed in Court which has been exhibited as ex 'x'. In the site plan, the portion falling to the share of the plaintiff has been marked in red. The back portion has not been marked since the exact area has to be measured and 15 square yards of land has to be provided to the plaintiff and the back portion would end at the place where such continuous 15 square yards of land ends. Three sides of the 15 square yards have been marked in red. ( 6 ) THE parties have agreed to withdraw all suits and claims against each other and there will be no further litigation between the parties in respect of the suit property. ( 7 ) A decree of partition of the said property be accordingly drawn up with exhibit 'x' forming part of the decree sheet on the plaintiff filing requisite stamp paper. Decree sheet be drawn up and duly registered. Parties are left to bear their own costs.
