Judgment 1. Heard learned counsel for the parties. 2. This is yet another writ application by retired employee of BISCOMAUN for nonpayment of his salary from November, 1996 to January, 2006 petitioner retired from the post of Salesmen-cum-Account Assistant, BISCOMAUN. 3. In the counter affidavit there is no dispute with regard to the claim of the petitioner as such. The pleading is nonavailability of fund. 4. If the petitioner has worked with the respondents he has right to claim and demand his salary. It is for the respondents to make the same available from whatever the sources they think fit. Non-availability of the fund cannot be made excuse to defeat the claim of the petitioner. This Court is not impressed by the defence which has been taken by the respondents for not paying the salary of petitioner from 1.4.1997 to 31.3.2006. 5. Respondents have the obligation to meet the liability and in this regard this Court gives six months time to respondent to take steps for payment of the salary of the petitioner, if not already paid. 6. This writ application stands disposed of with the above direction.
