On the other hand, the land would be deemed to be khud-kasht land of the temple and would accordingly be governed by clause (a) of Section 23 of the Jagir Act and constitute private property of the temple. In support he cited 1977 RRD 448. The learned Government Advocate, on the other hand, argued that this land did not belong to the temple, but was government land (Sawai Chak) and, therefore, khatedari rights could accrue to the persons and could not be said to be the khudkasht land of the temple. We have considered the matter. The S.D.O. does not appear to have properly examined this question. He only stated that the land had been entered as the khatedari land of certain persons and, therefore, could not be declared as private property. When the temple had claimed the land as belonging to itself, the S.D.O. ought to have examined the status of the persons who were given khatedari right and also the question as to whether the grant of khatedari rights was in accordance with law. This having not been done, we have no option but to remand the case to the S.D.O. for further examination in the light of the contentions raised on behalf of the appellant as also the State Government. It may, however, be stated for the guidance of the S.D.O. that if the land belonged to the temple, then as held in 1977 RRD 448 persons cultivating the land on behalf of the temple would be tenants of khudkasht and no khatedari rights would accrue to them as such accrual under Section 19 of the Rajasthan Tenancy Act would be hit by the provisions of Section 46 of that Act. The result would be the land would continue to the khudkasht land of the temple.
