JUDGMENT Permod Kohli, J. (Oral):- This revision is directed against the order dated 21.12.2006 passed by the Sikh Gurdwara Judicial Commission, Amritsar (hereinafter referred to as “the Commission”) rejecting the prayer of the present petitioner for grant of interim injunction under Order 39 Rules 1 and 2 read with Section 151 CPC. During the pendency of petition under Section 142 of the Sikh Gurdwara Act, 1925 (hereinafter referred to as “the Act”), the present petitioner made an application under Order 39 Rules 1 & 2 read with Section 151 CPC with the following prayer: “It is, therefore, prayed that the respondents be dismissed from the membership of the local Gurudwara if elected/nominated during the pendency of petition and restrained from contesting the election of functioning as such members/or to be employee, in the interest of justice & equity.” 2. The Commissioner has rejected the prayer on the ground that other members of the New Committee are not arrayed as respondents in the petition and the Committee has been constituted, but has not taken over the charge. Apart from the grounds mentioned in the impugned order, the prayer made in the application for interim relief is in fact the principal prayer in the petition under Section 142 of the Act. The allegations made by the petitioner are subject to scrutiny before the Commission. No such injunction can be granted at this stage. This petition is accordingly dismissed. However, the Commission may decide the petition under Section 142 of the expeditiously. —————————————
