ORDER : Dr. Arijit Pasayat and S.H. Kapadia, JJ. - Inspite of several orders of this Court, the pace at which operationalization of the sanctioned Anganwadi Centres is taking place is a sad reflection on the sincerity and seriousness of various State Governments to carry out the policy decisions relating to functioning of the Anganwadi Centres. It is shocking to note that even in respect of Anganwadi Centres sanctioned in 2005-2006 , in several States, the percentage of functional centres is very low. Glaring examples are the States of Bihar, Rajasthan, Himachal Pradesh, Kerala and Orissa. Though in some of the other States, 100 % operationalization has not been done, keeping in view the deadlines of phases as fixed by this court, but they are in most cases, more than 90%. It needs no reiteration that by various previous orders, emphasis was laid on the need for making of the sanctioned Anganwadi Centres functional. Taking note of the lapse so far as named States are concerned, notice of contempt is issued to the Chief Secretaries of the States of Bihar, Himachal Pradesh, Kerala, Rajasthan and Orissa to appear in person in this Court on 30th August, 20 0 7 . They shall file affidavits indicating the reason for non- compliance with this Court's orders and as to why exemplary action shall not be taken against them for not complying with this Court's orders. In the affidavits, they shall also indicate the names of the other officers who are responsible for not complying with this Court's orders. The affidavit shall be filed latest by 24th August, 2007. 2. Place this matter on 30th August, 2007 . 3. I.A. Nos.3 7 and 54 shall also be listed along with this matter.
