JUDGMENT 1. - Heard learned counsel for the petitioner, learned Public Prosecutor for the State and perused the relevant material placed before me. 2. Learned counsel for the petitioner has argued that 45 kg. of green plants of opium were recovered in the case and the said quantity would not produce opium weighing any quantity which can be said to be of commercial quantity under the Act and hence the accused petitioner should be granted the benefit of bail. 3. On perusal of the case diary,'it is revealed that the said green plants of opium were found standing in the crop of onion. Therefore, the accused petitioner should be granted the benefit of bail. 4. Learned Public Prosecutor opposed the bail application. 5. Taking into consideration the entire facts and circumstances of the case and without expressing any opinion, on the merits of the case, it is a fit case to grant bail to the petitioner under Section 439 Cr.P.C. 6. It is, therefore, ordered that petitioner Sh. Sanvarmal S/o Shri Manguram in F.I.R. No. 62/2007 registered at Police Station, Laxmangarh, District Sikar be released on bail provided he furnishes a personal bond in the sum of Rs. 25,000/- together with one surety in the like amount to the satisfaction of the learned trial Court with the stipulation to appear before that Court as and when called upon to do so.Bail application allowed. *******
