JUDGMENT 1. - Heard learned counsel for the petitioner. 2. Admit. Issue notice. Notice on behalf of respondents is accepted by learned Government Advocate Mr. JPS Choudhary. With the consent of learned counsel for the parties, the matter is disposed of finally. 3. The petitioners are permanent residents of Jaisalmer who initially applied for allotment of agricultural land under the Rajasthan Colonisation (Allotment and Sale of Government Land in the Indira Gandhi Canal Colony Area) Rules, 1975. The application for such allotment was rejected in 1999. Being appealed, the Additional Colonisation Commissioner and Revenue Appellate Authority remanded the matter back to the allotting authority vide order dated 23.1.2007 with direction to the allotting authority to issue a notification to consider the pending application. The Deputy Registrar (Colonisation) issued the order Annex. 12 by which they have fixed the date for allotment of land as 16.6.2007 to consider pending application of allotment for the year 2004. Since for all the petitioners who applied for allotment of land, the Additional Colonisation Commissioner and appellate Authority had already directed their cases to be considered by the allotting authority which as per the version of the counsel they are not going to consider. However, since their matters have been remanded by competent authority and allotting authority are bound to consider the cases of allotments to them as their applications for allotment are pending since 1994 and direction is for the pending applications of 2004 only, the allotting authority is supposed to consider the prior pending applications. 4. Hence the writ petition of the petitioners succeeds and is allowed and it is ordered that the petitioners application for allotment of land be considered in the meeting to be held on 16.6.2004 in accordance with law.Writ petitions Allowed. *******
