It is different thing to say that the specific provision of law has been ignored and it is a different thing that there is no provision in law for coming to a particular conclusion in respect of particular right. The source of law include judicial decision and the precedent laid down by the courts in respect of certain principle. When Rajasthan Tenancy Act does not forbid acquisition of Khatedari rights by an adverse possession and when there is no provision regarding the khatedari right in respect of those tenants where these rights are extinguished under Section 63(4) in view of the law of limitation in other words when the khatedari rights are extinguished under Section 63(4) they must repose in some other person khatedari rights will not remain in medio. Madhya Pradesh Tenancy Law specifically lays down that khatedari rights can be accrued by adverse possession and therefore the principle that a person can acquire khatedari rights by adverse possession is not in our opinion unknown to the legal word. Even the restriction against such sale was incorporated only on 22.9.56. Ratna sold his land after 22.9.56, but at that time the sale has not become void ab initio and the right of the seller was there to apply for recovery of possession.
