ORAL JUDGMENT : (Per A. H. JOSHI, J) 1. Rule. Rule is made returnable forthwith. 2. The State adopts the defence already raised while contesting Writ Petition Nos. 3423 of 2007, 3424/07 and 3425 of 2007 etc. 3. This Court has already decided the Writ Petitions No.3423 of 2007, Writ Petition No.3424 of 2007 and Writ Petition No.3425 of 2007 by common judgment. 4. Recording of separate reasons is, therefore, not necessary. 5. The present case proceeds on the same grounds except one factor namely the management of the present petitioner claims to be a minority Institution. The petitioner, therefore, claims right of admitting the students as available to minority Institution. 6. Admittedly, the Government has granted permission so the respondent University has given affiliation. In view of this, Rule is made absolute, and we pass the following order: (a) The direction given by us in Writ Petition No.3423 of 2007, Writ Petition NO.3424 of 2007 and Writ Petition No.3425 of 2007 shall apply to this case in so far as the time schedule and furnishing list etc., is concerned. (b) At the first stage, list for 49% intake capacity be furnished to petitioner, from which admission be done by the petitioner. (c) The petitioner shall prepare the list of candidates which it proposes to admit in the management quota, and it shall be furnished to the competent authority within 8 days from today, and same shall be considered and ruled upon by the authority within four days thereafter. (d) If upon such approval of the names from list so furnished, some seats remain un-filled, the Committee shall consider additional list forwarded by petitioner, and furnish approved list along with letter of approval to the management. (e) The petitioner management shall abide by the policy declared by the State Government in relation to the management quota, fee structure and reservation of seats furtherance to the reported judgment in case of P. A. Inamdar and others Vs. State of Maharashtra and others, (2005) 6 Supreme Court cases 537. (f) Certified copy expedited. Steno copy of this order be supplied to the learned Government Pleader free of cost.
