JUDGMENT 1. - Heard learned counsel for the petitioners and learned Public Prosecutor for the State. 2. Counsel for the petitioners submitted that the accused petitioners have been arrested on 31.5.2007 at 4.20 P.M. while the F.I.R. in these cases has been registered on 1.6.2007 at 12.30 A.M. in the night and there is no allegation that the accused petitioners had participated in putting the vehicles on fire or causing injuries to any member of the police force and they have been arrested on the apprehension of breach of peace and they are likely to commit cognizable offence, hence, their case is distinguishable with those who actually participated in the crime by forming unlawful assembly during the Gurgar Agitation regarding reservation which was wide spread in the State. 3. Learned counsel has also placed before this Court the papers and copy of the complaint prepared by the Police pertaining to proceedings under Sections 107/116 and 151 Cr.P.C. 4. Learned Public Prosecutor opposed the bail application but has agreed with the aforesaid factual situation of the case. 5. On hearing the rival submissions and after going through the papers on record, I find that no specific act has been attributed to the accused petitioners regarding putting the vehicles on fire of causing any injury to any member of the police force though there are three police personnel sustained minor injuries during the incident on the said day. The accused petitioners have already been released on filing their bail bonds for maintaining peace by the concerned authorities under the Code of Criminal Procedure and in the facts and circumstances of the case, I deem it proper to grant bail to the accused petitioners. 6. In the result, both the bail applications under Section 439 Cr.P.C. are allowed and it is directed that petitioners Laxman S/o Sultan and Arjun Lal Gurjar be released on bail in F.I.R. No. 130/2007 of Police Station Jamwa Ramgarh, district Jaipur, provided each of them furnishes a personal bond in the sum of Rs. 25,000/- with one surety in the like amount each to the satisfaction of the trial Court for their appearance before that Court on all dates of hearing and whenever called upon to do so.Bail applications allowed. *******
