ORDER R.P.S. Pawar, FC - The present petition has been filed for review of the order dated 3.1.2006 passed by the then F.C. Appeals-II, Punjab. 2. The review petition has been filed under Section 15 of the Act. Notice was issued to the respondent but he failed to appear and ex parte proceedings were ordered against him, on 24.1.2007. 3. I have also looked into the merits of the case. The plea of the petitioner that while setting aside his appointment as Lambardar, no finding on the argument led by the petitioner that the respondent was running a shop in Village Gajjar 7 km. away from the village has been recorded. This point was also highlighted before the Financial Commissioner, and despite ordering ex parte proceedings, against the respondent, even then order was passed in favour of the respondent. This has caused irreparable loss to the petitioner as inspite of making best efforts, he has not been able to get an order on merit. I have considered the above and find that injustice has been done and the party is continuously pursuing the case to secure justice. The power of the Financial Commissioner to review an order either passed by himself or by his predecessor is vast and enormous. The same however has to be exercised sparingly and judiciously and in cases, where it is amply established that review would be justified. 4. In view of above, the review application is accepted, the impugned orders dated 16.12.2004 of the Divisional Commissioner and 3.1.2006 of the then F.C.A.-II are set aside and the proceedings are remanded to the Divisional Commissioner with the direction to re-decide the whole issue afresh, in the light of my observations as recorded above. 5. The judgment in this case was reserved on 4.4.2007 and the order is hereby announced. To be communicated. Application allowed.
