ORDER : S.H. Kapadia, J. I.A. No. 1641 in I.A. No. 548 in W.P. (C). 202/95. 1. CEC has filed a report regarding laying of the pipeline through the Ratanpani Wildlife Sanctuary for supply of drinking water to Bhopal Town. The Government of Madhya Pradesh accepts the supplementary report dated 28.8.2007 of the CEC in which the following conditions were laid down:- (i) for the use of the forest land approval under the FC Act will be obtained and the stipulated conditions including the payment of the NPV will be complied with; (ii) 5% of the total project cost i.e. Rs. 12.00 crore will be deposited by the Project Authorities in the Compensatory Afforestation Fund for undertaking the conservation and the protection measures in the Ratapani Wildlife Sanctuary. Since the Compensatory Afforestation Fund has not become operational so far, it is recommended that a Committee consisting of the Principal Chief Conservator of Forests, the Chief Wildlife Warden and the concerned Conservator of Forests may prepare the scheme for undertaking the conservation and the protection works in the Ratapani Wildlife Sanctuary and the money required for the implementation of the works may be released by the Ad-hoc CAMPA to the Park Authorities as per the above scheme; and (iii) the conditions laid down by the Chief Wildlife Warden, State of Madhya Pradesh for the implementation of the projects within the sanctuary will be strictly complied with. 2. Heard learned amicus curiae, learned Solicitor General, learned counsel for Vedanta, the State of Orissa and O.M.C. 4. We see that in the Districts of Koraput and Kalahandi of Orissa State there is large extent of Bauxite deposit and CEC has filed details of the Bauxite bearing areas in the State of Orissa particularly in these two districts. We find that large number of applications are pending for mining licences. Some of them relate to the Orissa Mining Corporation. Most of these mining Bauxite deposits are in forests.

We do not have any comprehensive report regarding the extent of forest lands involved in these mining areas and we would like to have a report regarding the number of applications pending, the impact on the forests' if these applications are allowed and about the effect on the Tribal life habitation and ecology in all these Bauxite deposit areas. We would also like to seek the views of the MOEF regarding the safeguards which are to be imposed while giving the mining licences in any these areas. 5.
