JUDGMENT 1. - Heard on the application for withdrawal of the appeal. 2. Learned counsel for the appellant states that in view of the compromise between the parties, he wants to withdraw the present appeal. He further prays that the court fees paid alongwith the Civil First Appeal of Rs.5,815/- be directed to be refunded in view of the provisions of Section 61 of the Rajasthan Court Fees & Suit Valuation Act, 1961. Nobody appears on behalf of the respondents to oppose this application. 3. In view of this, the application is allowed. The appeal is dismissed as withdrawn. The court fees paid with the appeal of Rs. 5,815/- be refunded to the appellant.Application allowed. *******
