Notice Notice accepted ort behalf of State by Mr. Soni. Heard. 2. The petitioner No.1, a contractor, was allegedly awarded a contract for developing a piece of land belonging to M/s. Growth Techno Projects Ltd. He deposited an amount of Rs. 11,00,000/- on account of security with the said company. Subsequently, the project so awarded to the petitioner No.1 could not come through as the same was cancelled. The petitioner No. 1, in the circumstances, called upon the said company and petitioner Nos. 2 and 3 for refund of security deposit and on their declining to do so, he lodged a report with the police on the basis of which a case FIR No. 38/2007 under Sections 406/420, IPC was registered at Police Station Mandir Marg, New Delhi against petitioner Nos. 2 and 3 and another, who has since expired. The matter is still under investigation. In the meantime, the petitioner No.1, on one hand and petitioner Nos. 2 and 3 on the other have amicably settled the disputes between them and, as a result, amount of security deposit has been paid back to petitioner No. 1. The petitioner No. 1 has thus no grievance left and, in the circumstances, joins the petitioner Nos. 2 and 3 for quashing of the said FIR. On behalf of respondent/State there is no serious opposition to the prayer for quashing. 3. Keeping in view the nature of allegations as also the amicable settlement between the parties, it appears expedient in the interest of justice to apply a closure to the whole case by quashing the aforesaid FIR. The petition is accordingly granted and the aforesaid FIR is quashed. The petition is disposed of. Petition disposed of.
