JUDGMENT 1. - Heard learned counsel for the petitioner, learned counsel for the complainant and the learned Public Prosecutor and perused the case diary as well as the affidavit filed by Smt. Prem Devi who is prosecutrix as well as her husband Shyamlal. Both of them are present before this court and are, identified by their counsel. 2. It is submitted by the learned counsel for the petitioner that alleged incident is reported to have taken place in the month of February, 2007 whereas the report in the instant case has been lodged after four months of the incident. 3. Having gone through the case diary and in the present facts and circumstances, without expressing any opinion on the merits of the case, I am inclined to accept this bail application and grant the benefit of Section 438 Cr.P.C. to the accused petitioner. 4. Accordingly, the bail application under Section 438 Cr.P.C. is allowed. The concerned S.H.O. is directed that in the event of the arrest of accused petitioner Gyan Chand son of Surajmal, in connection with FIR No. 332/2007 Police Station, Shahpura, District Jaipur, he shall be released on bail on furnishing a personal bond in the sum of Rs. 20,000/- and two sureties in the sum of Rs. 10,000/- each to his satisfaction on the following conditions (i) He shall make himself available for interrogation by the Investigating Officer as and when required; (ii) He shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court or to Investigating Officer; (iii) He shall not leave India without the previous permission of the Court; (iv) He shall not commit similar offence. Bail application allowed. *******
