Judgment Surya Kant, J. 1. The prayer in this petition is to release the petitioner on regular bail in FIR No. 46 dated 07.02.2005, under Sections 148, 149, 323, 506, 302, 325 of IPC, registered at Police Station, Sadar Jhajjar. 2. As per the allegations contained in the FIR, which was registered on the statement of wife of the deceased (Gopi Ram), Rameshwar son of Shish Ram, Sumer son of Rameshwar, Inderjit son of Rameshwar, Rupa son of Mehram, Kapoor son of Rupa, Bhoop son of Rupa, Sonu son of Manphool, Giano wife of Rameshwar, who were armed with Lathi, Jelly, Pharsa, and Kulhari, started beating her son Pardeep and when he shouted for help, she along-with her husband Gopi Ram, brother-in-law Joginder, Dharambir and daughter Ritu rushed to help him. Then all the above named accused persons started beating the complainant and her companions. The complainants husband Gopi Ram also received injuries and became unconscious. He was rushed to P.G.I., Rohtak, where he succumbed to his injuries. 3. As per the Post Mortem Report, the deceased Gopi Ram was found to have received two injuries. The persons from the side of the accused party also received as many as 12 injuries. 4. Concededly., Ramehwar, Inderjit, Giano, Manphool and Sumer Singh co- accused of the petitioner have already been released on regular bail by this Court vide orders Annexures P-12 to P-15. 5. The petitioner had absconded and was declared proclaimed offender. He was arrested on 20.2.2007 and is in custody since then. 6. In the meanwhile, after framing of the charge, the complainant has also been examined and thus, there is no likelihood of tampering or influencing the witnesses upon which the prosecution case rests. 7. Learned State Counsel, however, fairly states that more than 24 witnesses are yet to be examined and as such, the conclusion of the trial will take considerably long time. 8. After surrender, the petitioner is in custody and as stated above, his co-accused have since been released on regular bail by this Court. 9. After hearing learned counsel for the parties and for the reasons aforesaid and without expressing any opinion on the merits of the case, this petition is allowed and the petitioner is directed to be released on bail on his furnishing bail bond to the satisfaction of Chief Judicial Magistrate, Jhajjar.
