JUDGMENT M.M. Kumar, J. - This is an application seeking condonation of 294 days delay in filing the review petition in respect of order dated 23.1.2004. According to the averments made in the application the applicants have challenged the order dated 23.1.2004 before Honble the Supreme Court in SLP No. 3729 of 2005 which has been decided on 11.11.2005. After the dismissal of SLP Review Application No. 3 of 2006 was filed on 12.12.2005. It has been asserted that the petitioner was prosecuting the proceedings before Honble the Supreme Court and in the process delay of 294 days in filing the Review Application has been caused. The applicant has asserted that the delay is not intentional and the applicant has got nothing to gain by the delay. 2. Notice of the application was issued and the prayer made by the applicant has been opposed by filing reply. 3. After hearing learned counsel for the parties, we are of the considered view that the application deserves to be accepted because it is undisputed that the applicant whose counsel had granted the concession which resulted into dismissal of his writ petition and thereafter with a bona fide belief had pursued the remedy of SLP before Honble the Supreme Court. The SLP has been dismissed on 11.11.2005 with the observation that that the validity of the order passed on 23.1.2004 in pursuance to a concession made by the counsel for the applicant is incorrect. Accordingly, Review Application No. 3 of 2006 has been filed. We find that the delay is bona fide which has resulted from pursuing the remedy of SLP before Honble the Supreme Court. Accordingly, the Civil Misc. Application is allowed and delay of 294 days in filing the Review Application is condoned. The Review Application is taken up for hearing today itself. Petition allowed.
