JUDGMENT 1. - With tho consent of the parties, this matter has been heard finally and is being decided at this stage. 2. By this writ petition, the petitioner is seeking appointment on the post of Constable with all consequential and notional benefits. 3. The facts in brief of the case are that in pursuance of the advertisement No. 5 dated 14.6.05 the petitioner appeared in the written test and qualified the physical test and interview and lateron medical test as well on 13.5.06 conducted for the post of Constable in General category. The petitioner has disclosed the fact of the pendency of criminal case in column No. 17 of the application form, but despite that petitioner has not been appointed. Thereafter name of petitioner stands in merit. Although the less meritorious persons have been appointed but he has not been appointed. 4. The State Government in the reply to the writ petition has submitted that the petitioner has concealed the facts in column No. 17 of the application form regarding FIR for the offence under Sections 147, 452, 323 and 427 IPC, therefore, he is not entitled for appointment. 5. This court on 23.7.07, directed the respondents to produce the original record of the selection of the petitioner. Record of the case has been produced before the court today and on perusal of the same, it is revealed that the fact of pendency of criminal case has been mentioned in column No. 17, and thus there is no concealment but it appears that due to pendency of the criminal case the petitioner has not been given appointment. The said pendency of criminal case is not disqualification for appointment under Rule 13 of the Rajasthan Police Subordinate Service Rules, 1954, therefore, there is no justification for not issuing the appointment order to the petitioner. 6. Accordingly, the writ petition is allowed and I direct the respondents to consider and appoint the petitioner, if found otherwise suitable, w.e.f. the date when the junior persons have been appointed and grant him all consequential and notional benefits within a period of one month.Writ petition allowed. *******
