Judgment 1. On special motion being made by some of the counsels of this Court on 1st October, 2007, this matter came up under the heading "To Be Mentioned" today. 2. It was reported that due to incessant and heavy rain, water logging is still continuing in many parts of Patna town of which Kankarbagh and Rajendra Nagar were worst affected. It was also informed that in other parts of Patna town, there was heavy water accummulation and no measures were taken by the authorities to come to the rescue of the public at large by draining out the accummulated water. Today, it is also reported by some of the counsels of this Court who are residents of different areas of Patna town that though water has receded in many parts of Patna town, water logging is still continuing in Kankarbagh areas and some parts of Sri Krishnanagar areas. 3. The Secretary, Urban Development Department, Government of Bihar, Secretary, Public Health Engineering Department, Govrnment of Bihar, Patna and Municipal Commissioner, Patna Municipal Corporation are present in court. 4. Two set of affidavits have been filed today; one on behalf of the Urban Development Department and the other on behalf of Patna Municipal Corporation stating therein that due to some unavoidable circumstances i.e. non-supply of electricity as it was disrupted due to felling of electric poles and trees etc., immediate measures could not be applied but no sooner the power supply was restored, the authorities did their best to start the pumping houses to drain out the stagnated water which resulted in draining out of water to much extent. It is also stated in the affidavits that by tomorrow, there will be complete draining out of stagnated water from different parts of the town provided electric supply remains uninterrupted. 5. At the same time the authorities who are present in court, have suggested that all possible measures would be applied to prevent such water logging in different parts of the town and immediate steps were also being taken to see that the water is not drained out by any other means than the proper means i.e. through the pump houses. 6. They also assured the Court that there will be proper cleaning of the municipal areas which remained under water for few days. 7. From time to time, it is observed in the orders that water logging is perennial in nature so far Patna town is concerned due to its geographical situation as it is situated on the bank of river Ganges and the flank of another river namely Punpun. From time to time, the authorities are reminded of their duties to keep vigil so that Patna town may not be submerged either by rain water or the waters of the rivers surrounding it. The court has also experienced that measures were taken no doubt and even today remedial measures are being applied but it should be prompted in view of recent Hathia rain which had disrupted normal life of Patna citizens. 8. No doubt, anxieties are being shown by the authorities and we have reasons to believe that they have done some satisfactory works as well but at the same time, we would like to observe that the works done by them require more promptness. 9. The authorities, in this view of the matter, are directed to take immediate steps to clean Patna town by employing sufficient numbers of persons and thereafter applying disinfectants like bleaching powder and lime stone in almost all parts of Patna town. At the same time, we also would like to observe that public awareness is also required and we hope and trust that public will also come forward in this regard to co-operate with the authorities by not throwing garbages etc. stray. 10. Before we part with this order, it is observed that public at large would be at liberty to report any inconvenience caused to them to the Municipal Commissioner, Patna Municipal Corporation, Secretary, Urban Development Department, Government of Bihar, Patna, Secretary, Public Health Engineering Department, Government of Bihar, Patna and also the District Magistrate, Patna which would be entertained and necessary action would be taken, if required. 12. List this matter again on the next date fixed. 13. Mr. Ghosh, learned Additional Advocate General No. 2, however, undertakes to give a copy of this order to the District Magistrate, Patna who is not present in court today. 14.
