JUDGMENT 1. - Petitioner has challenged the order dated 30.11.1984 by which in a proceeding under Rule 17 of the CCA Rules the punishment of stoppage of three annual grade increments with cumulative effect has been imposed as also the order dated 30.08.2000 by which appeal against the above punishment order has been dismissed by the appellate authority on the ground of limitation. The petitioner has prayed for all other consequential benefits including the retiral benefits. 2. The petitioner applied for voluntary retirement and his application was allowed vide order dated 16.02.2000. The petitioner was voluntary retired from service w.e.f. 31st March, 2000. It has been alleged that their impugned order of punishment dated 30.11.1984 was never communicated to the petitioner. Even as per reply filed on behalf of the respondents, the order of punishment dated 30.11.1984 was implemented only vide order dated 22.09.2000 making deductions from the arrears to be paid to the petitioner. There is no justification or any plausible reason given by the respondents as to why the order of punishment was not implemented till his retirement. There is also no material placed on record on behalf of the respondents that the punishment order had ever been communicated to the petitioner. The petitioner has served for more than 15 years after the alleged order of punishment and even the order of voluntary retirement does not mention any fact about the above punishment. Be that as it may, as per settled law, even s the major punishment of stoppage of three grade increments with cumulative effect could not have been imposed in a proceeding under Rule 17 of the CCA Rules. A bare reading of the reply filed on behalf of the respondents would show that same is absolutely vague and evasive. The authorities had acted just in a casual cursory manner. 3. Accordingly, the writ petition is allowed. The impugned order of punishment dated 30.11.1984 is set aside. The respondents are directed to make proper fixation ignoring the above punishment and payment of all arrears including that of difference of retirement benefits be paid to the petitioner within sixty days from the date of receipt of certified copy of this order. The petitioner stood retired from 31st March, 2000 and he has been denied his dues without any justifiable grounds. Under the circumstances, the respondents are directed to pay a cost of Rs.
