JUDGMENT 1. - This appeal has been preferred against the impugned award dated 21.2.2005 passed by the Motor Accidents Claims Tribunal, Dholpur in a Claim Petition No. 97/2004 whereby a sum of Rs. 2,10,000/- has been paid as compensation on account of death of 40 years person in a road accident on the ground that the award is on lesser side. 2. Learned counsel for the appellants has submitted that the claimants have pleaded the income of deceased as Rs. 3,000/- per month whereas the Tribunal has determined her income as Rs. 1,000/-. It is made out that the deceased lady was working as labourer and the prevalent rate to be paid in the year 2004 was Rs. 73/- per day as paid by the Government to a labourer. Taking into consideration Rs. 70/- per day, his, monthly income comes to Rs. 2,100/- though ⅓rd amount in such lower strata of society could not be spent by such a lady as her personal expenses and after application of multiplier of 15, loss of dependency comes to Rs. 2,52,000/- instead of Rs. 1,92,000/-. Tribunal has paid Rs. 18,000/- for love and affection which is maintained. Award is modified to that extent. 3. Consequently, the appeal is partly allowed. No order as to costs.Appeal partly allowed. *******
