ORDER 1. Place the matters on 31st January, 2008. I.A. No. 18: (Re: Mr. V.S. Srivastava) 2. Heard learned counsel for the applicant. 3. The interlocutory application is dismissed. In re.: State of West Bengal: 4. It has been stated on behalf of the State of West Bengal that persons whose names have been enumerated in Annexure R-1 were issued notices for vacation but it has been nowhere stated as to why no proceeding under Public Land Encroachment Act has been initiated. The State should state on affidavit as to why no such proceeding has been initiated. If any such proceeding has been initiated, its number and stage should be mentioned. In case, no proceeding has been initiated, the proceeding shall be initiated within a period of one month from today. 5. Place the matters on 31st January, 2008. In I.A. No.16: 6.
