JUDGMENT 1. - Petitioner has challenged the order dated 04.10.1999 passed by the respondent Labour Department refusing to refer the dispute in regard to termination of services of the petitioner for adjudication to a competent court. The refusal has been made only on the ground that the petitioner had sought voluntary retirement under the scheme and has also received the benefits thereunder. 2. Learned counsel for the petitioner, while referring to various complaints made by the petitioner, has submitted that in view of serious allegations in regard to the petitioner been forced to submit the application for voluntary retirement, the impugned order was not legal and justified whereas learned counsel for the respondent Company submitted that the impugned order was an administrative order and the petitioner having received the benefits now cannot challenge the order of voluntary retirement. 3. A bare perusal of the allegations and counter allegations made and failure report of the Conciliation Officer would show that there are serious disputed questions of facts and law involved and the same could be decided only by a competent court after taking evidence of both the parties. The adjudication in such circumstances could not have been denied to the petitioner in such a casual cursory manner. Mere acceptance of the benefits can never debar the workman from challenging the impugned orders if the same is otherwise not legal or in accordance with law. Without making any observations on merits at this stage, in my opinion, the impugned order passed by the respondent department cannot be sustained. 4. Accordingly, the writ petition is allowed. The impugned order dated 04.10.1999 is set aside. The respondent department is directed to refer the dispute in regard to termination of service of the petitioner for adjudication to a competent court within thirty days from the date of receipt of certified copy of this order. It is also expected from the court concerned to expedite the hearing of such dispute.Writ Petition Allowed. *******
