JUDGMENT : This public interest litigation relates to absconding of dreaded criminals, namely Rambabu Gadariya, Dayaram, Pratap and Gopal from the police custody. After absconding from the police custody, these dacoits have created terror and recently they have murdered 14 innocent persons in village Bhanwarpura but the State authorities are not at all concerned. This petition is pending from the year 2001. Repeated opportunities have been given to State to conduct enquiry and submit the report regarding the action taken against the concerned officers on whose connivance the said persons have escaped from police custody. 2. The petitioner has prayed that the CBI be directed to investigate the whole matter. 3. In this matter, the Principal Secretary (Home) informed the court that he will be holding enquiry by appointing a very senior officer regarding the conduct of the senior police officers and Superintendent, senior jailor, Central Jail and other officers regarding escape of those accused. The enquiry was being conducted by the Secretary, Food and Civil Supplies, but it could not be completed because the concerned officer had left on deputation. 4. In this view of the matter, we deem it appropriate to direct the Chief Secretary of the State of Madhya Pradesh to appoint the Addl. Chief Secretary to conclude the enquiry as expeditiously as possible and in any event within three months from today and submit a report to this court.
