Judgment 1. Let the reply to the show cause filed on behalf of opposite party no. 2 be kept on the record. 2. This is a Misc. Case filed on behalf of the informant, Juma Khatoon, for the cancellation of bail granted to opposite party no. 2, Md. Taiyabul Haque @ Md. Taiyab Bul Haque in Misc. Case No. 20470 of 2007 on 11.5.2007. 3. Learned counsel for the petitioner submits that the bail order was obtained on the basis of compromise petition between the parties but as a matter of fact there was no compromise in between the parties and therefore he prays for cancellation of bail. 4. Learned counsel for the opposite party no. 2 submits that there was a case between the husband of the informant and the petitioner having some sections of the offence in which the impugned compromise petition was filed and by mistake the said compromise petition has been filed in the present case. He, therefore, submits that this is a bona fide mistake and, hence, the show cause may be accepted. 5. Considering the submissions advanced on behalf of both the parties I find that the bail order has been obtained on the basis of compromise petition which had taken place in the earlier case and that compromise petition has been filed in this case with mala fide intention to obtain bail. 6. In the facts and circumstances of the case, the present Misc. Case is allowed and the bail order dated 11.5.2007 passed in Cri. Misc. No. 20470/07 is hereby cancelled. Opposite Party No. 2, Md. Tiyabul Haque @ Md. Taiyab Bul Haque is directed to surrender in the court below forthwith. In case he does not surrender in the court below within 15 days the trial court in seisin of the case is directed to take coercive step for his arrest.
