JUDGMENT Honble S.P. Mehrotra, J.—It appears that Civil Misc. (Compromise) Application No. 158358 of 2005 was filed in the Second Appeal mentioning the names of the proposed heirs and legal representatives of the deceased Ali Hussain (appellant) as well as the names of the respondents including the names of the proposed heirs and legal representatives of the deceased-respondents. 2. The aforesaid Compromise Application is supported by an affidavit, sworn by Mohd. Mustafa (respondent No. 14) and Muneer Hasan (respondent No. 9/4). 3. By the order dated 24-4-2006 passed by this Court, the aforesaid Compromise Application was sent to the Trial Court for verification. 4. It further appears that the learned Civil Judge (Junior Division), Mohamdabad, Azamgarh by his Communication dated 25-4-2007 has sent back to this Court the aforesaid Compromise Application alongwith the record. 5. It is, inter alia, stated in the said Communication dated 25-4-2007 that the aforesaid Compromise Application was finally verified on 23-4-2007. 6. A perusal of the order-sheet of the learned Civil Judge (Junior Division), Mohamdabad, Azamgarh in respect of the aforesaid Compromise Application shows that in the order dated 23-4-2007, the learned Civil Judge (Junior Division), Mohamdabad, Azamgarh has noted that the parties have verified the aforesaid compromise, and there remains no party who has not verified the compromise. 7. Shri S.A. Ansari and Shri Rafat Raza Khan, learned Counsel for the contesting parties are present. They submit that in view of the fact that the compromise as contained in the aforesaid Compromise Application and its accompanying affidavit, has been verified by the parties, the Second Appeal may be decided in terms of the said compromise. 8. I have considered the submissions made by the learned Counsel for the parties, and perused the record. 9. From the narration of the facts given above, it is evident that the said compromise, as contained in the aforementioned Compromise Application and its accompanying affidavit, has been duly verified by the parties before the learned Civil Judge (Junior Division), Mohamdabad, Azamgarh. 10. In the circumstances, the Second Appeal is decided in terms of the said compromise as contained in the aforementioned Compromise Application and its companying affidavit. The aforementioned Compromise Application and its accompanying affidavit will form part of the decree. ————
