ORDER 1. Issue notice to respondents 4 and 5. Notices should go both by ordinary process and by registered post talbana and other requisites for which must be filed by 20.12.2007. 2. This matter was taken up on several occasions. However, it appears that no counter affidavit has been filed in this case. 3. Counsel for the petitioner has made a prayer for relaxation of age of Ex-serviceman so that they could fill in the forms and taken the examinations which are going to be held on 24.2.2008 by the Bihar Public Service Commission. 4. Learned counsel for the petitioner submits that the last date for filling up the form is 17.12.2007 and till date no instructions have been received either from the State or the Commission and as such no counter affidavit has been filed. 5. I accordingly direct that respondents 4 and 5 should allow the petitioner to fill in the forms with respect to Advertisement No.4/2007 issued on 6.11.2007 to persons who are Ex-servicemen. However, the petitioner will only be permitted to sit in the examination after the orders of this court. 6. It is hoped that in the meanwhile the State and the Commission will file their respective counter affidavits stating whether this relaxation of age is permissible for Ex-army personnel’s. 7. The date for filling in the forms is extended by 26.12.2007 only for those category of persons who are Ex-servicemen (Army, Air Force and Navy personnel’s). 8. List this case on 15.1.2008 at the top of the list.
