Judgment , J. 1. This petition seeks a direction for refund of fee. 2. Case of the petitioner is that lie took admission in B.Sc. course in 2006- 07 and paid the fee. However, he got admission to some other institute later on and he sought refund. The refund was not given. 3. In the reply filed, the stand taken is that as per prospectus, the fee once recovered, cannot be refunded. 4. We have already examined the issue in judgment dated 12.7.2007 in CWP No. 5793 of 2007 (Aayush Gupta v. Panjab University) and it was held that unless it could be shown that any prejudice is caused to the University, the fee paid by a candidate has to be returned. 5. Accordingly, we allow this petition and direct that except for the expenses, if any, incurred or loss, if any caused to the University, the remaining amount be refunded to the petitioner within one month from the date of receipt of a copy of this order, if the same has not already been refunded.
