Judgment 1. This petition seeks a direction for refund of fee. 2. Case of the petitioner is that she was admitted to BDS in the year 2006 and she paid fee for that purpose. However, she got admission to MBBS course and She secured the BDS seat. She thereafter sought refund of the fee on the ground that the seat had already been given to some other student but this claim was rejected. 3. Notice was issued to the University but no reply has been filed. 4. We have already examined the issue in judgment dated 12.7.2007 in CWP No. 5793 of 2007 (Aayush Gupta v. Panjab University) and it was held that unless it could be shown that any prejudice is caused to the University, the fee paid by a candidate has to be returned. 5. Accordingly, we allow this petition and direct that except for the expenses, if any, incurred or loss, if any caused to the University the remaining amount be refunded to the petitioner within one month from the date of receipt of a copy of this order, if the same has not already been refunded. Petition allowed.
