Judgment , J. 1. This petition seeks a direction for refund of fee. 2. Case of the petitioner is that he was given admission in BDS course at Dr. H.S. Judge Institute of Dental Sciences and Hospital, Panjab University, Sector 25, Chandigarh. He deposited the fee and joined the classes commencing 1.8.2006. On 5.8.2006, he surrendered the seat as he got admission elsewhere. The seat surrendered by him was filled up by giving admission to some other student. He paid the requisite tee. In these circumstances, he was entitled to refund of the fee deposited. 3. In the reply filed, the stand taken is that as per prospectus, the fee once recovered, cannot be refunded. 4. We have already examined the issue in judgment dated 12.7.2007 in CWP No. 5793 of 2007 (Aayush Gupta v. Panjab University) and it was held that unless it could be shown that any prejudice is caused to the University, the fee paid by a candidate has to be returned. 5. Accordingly, we allow this petition and direct that except for the expenses, if any, incurred or loss, if any caused to the respondents, the remaining amount be refunded to the petitioner within one month from the date of receipt of a copy of this order, if the same has not already been refunded.
