Judgment , J. 1. This petition seeks quashing of order dated 10.5.2007, Annexure P-17, withdrawing one increment from the basic pay of the petitioners retrospectively. It was held that there was error in allowing second time bound promotional scale. 2. Learned counsel for the petitioners has not been able to show any error insofar as revision of pay scale is concerned, which has been clone to correct an error. The said order is, thus, upheld. 3. Next contention raised on behalf of the petitioners is that even if revision of pay scale was justified, excess wrong payment could not be recovered when the employee did not make any misrepresentation or fraud and the payment was made by applying a wrong principle which was found to be erroneous. 4. We find merit in the contention in view of judgment of Honble Supreme Court in Col. B.J. Akkara (Retd.) v. Government of India and others, 2006(11) SCC 709. 5. Learned counsel for the Electricity Board is unable to distinguish the applicability of judgment of the Honble Supreme Court in Col. B.J. Akkara (supra). 6. Accordingly, we allow this petition to the extent that no recovery will be effected from the petitioner as a result of the impugned order. The petition is disposed of.
