Judgment Surya Kant, J. 1. The prayer in this petition is to transfer the case titled as State v. Jaswinder Kaur arising out of F.I.R. No. 150 dated 6.10.2006 under Sections 447/511 IPC, registered at Police Station B Division, Amritsar from the Court of learned Judicial Magistrate, Ist Class, Amritsar to the Court of competent jurisdiction at Ferozepur. 2. The above-stated F.I.R. has been registered on the statement of Balwinder Kaur, who is sister-in-law of the petitioner, namely, wife of brother of the petitioners husband. 3. The facts may be noticed briefly. 4. The petitioner was married to Surinder Singh on 30.3.1998. There are two children out of the wedlock who are presently in the custody of the petitioner. The husband of the petitioner is a Police Commando in Punjab Police and it appears from the subject F.I.R. that Lakhbir Singh-husband of the complainant Balwinder Kaur is also working in the Police Department. 5. There is an unfortunate matrimonial dispute between the petitioner and her husband Surinder Singh which led to initiation of various cases between the parties as per the following details :- (i) Surinder Singh-husband of the petitioner has filed a divorce petition under Section 13 of the Hindu Marriage Act which is pending in the Court of learned Additional District Judge at Ferozepur; (ii) The said Surinder Singh and other accused are facing trial in a case under Section 406/498-A IPC in the Court at Ferozepur; (iii) A criminal complaint against Surinder Singh as well as the complainant in the present F.I.R., namely, Balwinder Kaur under Sections 323/325 IPC is pending in the Court of learned Judicial Magistrate, Ist Class in Ferozepur; and (iv) Two execution applications arising out of proceedings under Section 125 Cr.P.C. initiated by the petitioner and her minor children are also pending in the Court at Ferozepur. 6. The present case, however, was got registered at the Police Station B- Division, Amritsar and as such, the proceedings arising therefrom are pending in the Court of learned Judicial Magistrate at Amritsar. As per the allegations, the petitioner entered the house of her in-laws and threatened the complainant. 7. Nothing more is required to be observed except to say that prima facie, the petitioner is sought to be harassed merely because her husband and latters brother both are employed in the Police Department.

This aspect, however, shall be gone into by the learned Judicial Magistrate only as it does not appear expedient to express any views on merits of the case at this stage. 8. Be that as it may, since all the cases between the parties are pending at Ferozepur, the subject case titled as State v. Jaswinder Kaur arising out of F.I.R. No. 150 dated 6.10.2006 under Sections 447/511 IPC, registered at Police Station B Division, Amritsar, which is pending in the Court of learned Judicial Magistrate, Ist Class, Amritsar, is also ordered to be transferred to the Court of competent jurisdiction at Ferozepur. This petition is accordingly allowed. The learned Chief Judicial Magistrate, Ferozepur shall entrust the above- stated case to a Court before whom one or the other matter between the parties is already pending and the said trial Court, in turn, shall ensure that, as far as possible, the hearing of this case be also fixed for the same date so that minimum hardship is caused to the parties. The parties are directed to appear before the learned Chief Judicial Magistrate, Ferozepur on 23.11.2007. Let a copy of this order be given Dasti to learned counsel for the petitioner on payment of usual charges as also to the learned State Counsel.
