JUDGMENT 1. - Instant petition U/s. 482, Cr.P.C. has been filed assailing condition No. 2 incorporated in order dated 13.06.06 passed by Sessions Judge, Sikar while releasing Maruti Car on superdginama in favour of petitioner. 2. FIR-63/06 was lodged at PS Kotwali (Sikar) for offences U/Ss. 325, 366, 307 IPC. Pendente investigation, Maruti-800 Car (RJ-18-C-4996) of manufacturing year 1988 as shown in Registration certificate (Ann. 1) was seized by investigating agency. 3. Petitioner filed an application for release of aforesaid vehicle on superdginama U/s. 451, Cr.P.C. Learned trial Judge after taking note of material on record, allowed the application and ordered to release aforesaid Maruti Car in favour of petitioner stipulating five conditions including condition No. 2 impugned that status of sureties shall be verified by Tehsildar and other competent authority. 4. Counsel for petitioner submits that as per condition No. 1 incorporated vide order impugned, the petitioner has to furnish a solvent security of Rs. Four lacs and two sureties each of Rs. Two lacs for release of vehicle of 1988 year model on superdginama and in such circumstances, condition No. 2 impugned (supra) will certainly frustrate very purpose with which vehicle has been directed to be released on superdginama and will certainly create some legal complications, as well. 5. Learned Public Prosecutor supported the condition No. 2 impugned and submits that it is always in the interest of justice to get status of sureties verified through competent authority before the sureties are accepted for release of vehicle in question. 6. Looking to the fact that Maruti-88 car is of 1988 year model and a solvent security of petitioner is required to be furnished in terms of condition No. 1 under order impugned, no purpose is going to be served in putting further condition No. 2. 7. Consequently, misc. petition succeeds and is hereby allowed and condition No. 2 incorporated in the order impugned dated 13.06.06 is quashed and set aside.Petition allowed. *******
