JUDGMENT 1. - Since on similar set of facts same relief has been claimed, all the writ petitions have been heard together and are being decided by this common order. 2. The State Government vide-notification dated 26.3.1998 made an amendment in the Rajasthan Civil Services (Revised Pay Scales) Rules, 1998. In Schedule-V of the amendment, pay-scales to the post of Constable, Head Constable and Sub-Inspector were also revised w.e.f. 1.9.1996. The pay-scale of Constable was revised from 2750-4400 to 3050-4590 and that of Head Constable from 3050-4590 to 3200-4900. The pay scale of Sub-Inspector was revised from 5000-8000 to 5500-9000. All the petitioners had been working in the Police Telecommunication Department on the above respective posts. However, benefit of revision of pay-scales after completion of 27 years of service as per the Schedule, referred above, was not given to them only on the ground that being working in Telecommunication Department, the amendment made for the Police Department is not applicable on the petitioners and such other similarly situated persons working in the Telecommunication Department. 3. Learned counsel for the petitioner submitted that the controversy has already been decided by this Court in the case of Om Parkash v. State & Ors., S.B. Civil Writ Petition No. 1367/2003 decided on 12.7 2006 . While referring to judgment referred above, this court again decided the issue in S.B. Civil Writ Petition No. 5556/05, Ashok Kumar & Ors. v. State & Ors., decided on 9.11.2006 . The above judgments have further been affirmed by this court in the case of Bachan Singh v. State & Ors., S.B. Civil Writ Petition No. 8983/05 decided on 9.4.2007 . The court further observed that in view of controversy already decided, the dispute does not require further adjudication. Relying on judgments of this court, as referred above, the Rajasthan Civil Services Appellate Tribunal, Jaipur also decided number of appeals filed by respective employees with necessary directions to give benefit of revision of pay-scale as per notification, referred above. 4. After having carefully gone through the material on record as also judgments referred above. I find no ground for taking any contrary view, moreso, when as per submissions of the learned counsel for the parties, the orders passed by this court as also Tribunal in regard to present controversy have already been implemented by the respondents.

It is rather unfortunate that once the controversy had already been decided by this court in number of writ petitions at the Main Seat as also this Bench, the Department is not giving benefit to all similarly situated persons and the benefit is extended only to the employees who see remedy before this court or the Tribunal. The respondent-Department suo motu should have issued necessary directions to give benefit of revision of pay-scales to all similarly situated employees working in the Telecommunication Department. 5. Accordingly, the writ petitions are allowed. Respondents are directed to give benefit of revision of pay-scale as per notification dated 26.3.1998 to the petitioners on their respective posts. Necessary orders be passed within 30 days from the date of receipt of certified copy of this order and all arrears may also be paid within 30 days thereafter.Petition allowed. *******
