Judgment : Per G. RAJASURIA, J. 1. This petition is field to direct the respondents to register a case in respect of theft of 16 sovereigns of gold jewels by bureau pulling occurred on 23.6.2005 during night hours as against the then Crime S.I. Mr. Illanchezhian and the then Crime Writer -Mr. Veerasamy of Palani Town Police Station and other unknown offenders for the commission of offences under Sections 119, 120-B, 201, 202, 212, 218, 221, 225-A, 457and 380 I.P.C. and also to direct to take necessary actions against the accused. 2. Heard both sides. 3. At the hearing the learned Government Advocate (Crl. side) would submit that so far, the police is not in receipt of the Complaint dated 10.12.2005 allegedly sent by the petitioners father to the police. 4. However, the learned counsel for the petitioner would draw the attention of the Court to the typed set of papers and he would submit that the Complaint dated 3.12.2005 was sent on 10.12.2005 relating to the theft incident to the three high-level police officers. A copy of the postal receipt is also found in the typed set. 5. Be that as it may, without going into the allegations and counter allegations the following direction is issued : Let the petitioner appear before the respondent police concerned within 10 days from the date of receipt of a copy of this order and lodged a Complaint thereupon the police shall receive it. If it discloses the commission of cognizable offence, they shall deal with the matter keeping in mind the provision under Section 154, Cr.P.C. and the decisions of the Honourable Apex Court in.Prakash Singh Badal v. State of Punjab (2007) 1 SCC 1 : (2007) 2 MLJ (Crl) 1262, and in Lallan Chaudhary and Others v. State of Bihar and Another (2007) 1 SCC (Crl.) 684 : (2007) 1 MLJ (Crl) 241and do the needful. Whatever be the decision taken, the same shall be communicated to the petitioner for taking further action at his end. 6. With the above observation, this Petition is closed.
