JUDGMENT 1. - Heard learned counsel for the petitioners and the learned Public Prosecutor for the State. 2. Learned counsel submits that the accused petitioners are in custody since 3.9.2007 and challan has been filed and the complainant is a foreign national and he has left India and as such the trial is likely take time. Learned counsel cited (2000)9 SCC 533 Ashok Dhingra V/s. N.C.T. of Delhi in support of which contention. Therefore, learned counsel requested for benefit of bail to the accused petitioner. 3. Learned Public Prosecutor opposed the bail but conceded the aforesaid fact situation. 4. In view of the submissions and all other facts and circumstances of the case, it is fit case to grant bail under Section 439 Cr.P.C. 5. It is ordered that the accused petitioners Babu Khan @ Gupta S/o Nabbu Khan & Khadim S/o Hazi Mohammad Ayub in F.I.R. no. 98/2007, Police Station, Ramgarh Sethan, Distt. Sikar (Rajasthan), shall be released; provided they furnish a personal bond of Rs. 50,000 and two surety bonds of Rs. 25,000 each to the satisfaction of the learned trial court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so. *******
