JUDGMENT 1. - Heard learned counsel for petitioner, learned Public Prosecutor for the state and perused the relevant documents placed before me. 2. Learned counsel for the petitioner argued that the theft pertains to a mobile set from the shop and the accused petitioner was arrested after three months of the occurrence and one mobile set of Nokia made, has been recovered from his possession. Challan has been filed. The trial is likely to take quite some time. Hence the benefit of bail should be given to him. 3. Learned PP opposed the bail application hut conceded the fact situation. 4. In view of the submissions made at the bar and all other facts and circumstances of the case, it is a fit case to grant the benefit of bail to the accused petitioner. 5. In the result, this bail application under section 439 Criminal Procedure Code is allowed and it is directed that petitioner Arun Kumar @ Neenu S/o Shri Brij Kihor shall be released on bail in F.I.R. No. 169/2007 P.S. Mundawar, District Alwar, on his furnishing a personal bond in the sum of Rs. 50,000/- together with two sureties in the sum of Rs. 25,000/- each, to the satisfaction of the concerned Court for his appearance before that Court on all dates of hearing and whenever called upon to do so.Petition allowed. *******
