JUDGMENT 1. - Heard learned counsel for the petitioner and learned Public Prosecutor for State and also perused the material on record. 2. The petitioner is father-in-law. Learned counsel for the petitioner has placed on record number of documents in respect of his submissions. The marriage between Amit Bhardwaj and Hunni Arora had taken place on 10.9.2003, which was a self selection, and the same was duly registered in the office of Registrar I Hindu Marriage (Collector), Alwar. The rashan card of the petitioner has also been placed on record to show that the father-in-law is living separately. A detailed representation was also submitted by the petitioner to the Hon'ble Home Minister and other Authorities which is self-explanatory. At one point of time, it is stated that an application under Section 13-B of Hindu Marriage Act, 1955, for the purpose of mutual divorce, was also filed on 16.10.2007, but the same was withdrawn by the informant, wife on 24.10.2007. A complaint was also lodged by the husband, Amit Bhardwaj against the wife and her brother on 27.10.2007. 3. Without expressing any opinion on the merits of the case but taking into consideration the documents placed on record as well as the overall facts and circumstances of the case, I deem it just and proper to grant indulgence of anticipatory bail to the petitioner under Section 438 Cr.P.C. 4. The S.H.O./I.O./Arresting Authority, Mahila Police Station, Alwar, in F.I.R. No. 138/2007 is directed that in the event of arrest of the petitioner Murari Lal Sharma S/o Shri Deen Dayal Sharma, shall be granted bail provided he furnishes a personal bond in the sum of Rs. 50,000/- together with two sureties in the sum of Rs. 25,000/- to his satisfaction on the following conditions : (a) that the petitioner shall make himself available for interrogation by a Police Officer as and when required; (b) that the petitioner shall not directly or indirectly make any inducement, threat or promise to; any person acquainted with the facts of the case as to dissuade him from disclosing such facts to the Court or any Police Officer, and (c) that the petitioner shall not leave India without previous permission of the Court.
