JUDGMENT Hon’ble H.L.Gokhale,CJ.—Heard Smt. Kamla Singh in support of these two appeals and Mr. P.D. Tripathi, learned Standing Counsel appears for the respondents 2. The certified copy of the order is filed with the accompanying Special Appeal No. 1180 of 2007. The filing of the certified copy in Special Appeal (Defective) No. 770 is dispensed with. The defect is removed. The appeal be given regular number. 3. The first appeal is filed by one Smt. Saroj Rani and one Chandrabeer Singh whereas the second appeal is filed by one Smt. Sangeeta Kumari, one Thakur Singh and one Rajendra Kumar. 4. The appellants who are five in number, had filed a writ petition bearing No. Civil Misc. Writ Petition No. 38564 of 2007 challenging their transfer orders. They are working as teachers in Junior High School in district Moradabad and they have been transferred from one block to another within the same district. 5. Smt. Singh, learned Counsel appearing for the appellants submits that out of these five teachers, two are ladies and as per the Government policy dated 31.5.2006, ladies are not to be disturbed as far as possible. They are to be given preference in accommodating them either at the place wherever they are working or at the adjoining block. They are transferred to far off places. 6. As far as three male teachers are concerned, it is submitted that they have their own problems and that some of them like Chandrabeer Singh is a single science teacher in the concerned school and should not have been transferred. 7. The learned Single Judge has dismissed the petition filed by the appellants by observing that the transfer is an exigency of service. 8. This being the position, in our view, as far as male teachers are concerned they should join at the places wherever they are transferred. They may make representation and their representation will be considered by the authorities appropriately. As far as two lady teachers namely Smt. Saroj Rani and Smt. Sangeeta Kumari are concerned, under the relevant rule, they have preference to remain at the place wherever they are working or at the adjoining block. 9. We allow both the appeals to this limited extent and direct the respondent-authorities to retain these two lady teachers and accommodate them at the place wherever they are working or at the adjoining block. ———
