Judgment :- the 1st and 2nd respondents herein to issue directions forbearing the 3rd respondent from plying its buses at 5.28 PM from Dindigul towards Madurai, ahead of the timings of the petitioners bus TN 58 J 9194 plying on the route Madurai to Dindigul (via) Samayanallur, Vadipatti etc., without proper fixation of timings in accordance with law. 2. Heard Mr. C.R.Krishnamoorthy, learned counsel for the petitioner as well as Mr.A.Arumugam, learned Additional Government Pleader for the respondents. 3. The learned counsel appearing on behalf of the petitioner had submitted that the petitioner is operating a Stage Carriage bus TN 58 J 9194 on the route Madurai to Dindigul (via) Samayanallur, Vadipatti, Kodai Road and Gandhigramam for a very long time and the Stage Carriage bus belonging to the petitioner departs from Dindigul towards Madurai at 5.32 PM (via) Gandhigramam, Kodai Road etc. 4. While so, the first respondent has issued permit to third respondents division buses to operate on the route Salem to Madurai (via) Karur, Dindigul etc., without holding the timing conference and without giving an opportunity to the petitioner. Though the petitioner had sent representations, on 13. 2007 and 6. 2007, they have not been disposed of by the respondents. 5. Though the prayer is for a larger relief, the learned counsel appearing on behalf the petitioner has confined his argument to the limited extent of directing the first respondent to consider and dispose of the representation of the petitioner, dated 13. 2007, within a specified period. 6. Considering the limited prayer sought for by the learned counsel appearing on behalf of the petitioner, without going into the merits of the case, the first respondent is directed to consider and dispose of the representation of the petitioner, dated 13. 2007, on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order, after affording reasonable opportunity of hearing to the petitioner. The petitioner is directed to furnish a copy of the representation, dated 13. 2007, to the first respondent, along with a copy of this order. 7. With the above directions, this Writ Petition is disposed of. No costs. Consequently, connected M.P.(MD) No.1 of 2007 is closed.
