Judgment :- This Civil Miscellaneous Appeal is directed against the order of the District Judge, Salem made in F.O.P.No.209/1988. 2. It is stated that during the pendency of CMA, claim has been settled under Non-Discretionary Scheme introduced by the respondent/ TIIC. It is also stated that as per the said Scheme, interest to be paid was waived off and the appellants have paid a total sum of Rs.4,19,273/- to the respondent/TIIC towards full and final settlement of the claim made by the respondent, which is the subject matter of the appeal. On behalf of the appellant, memo has been filed to this effect and it is recorded. Recording full and final settlement, the CMA is disposed of. There is no order as to costs. 3. At the time of obtaining loan, the appellant has deposited original documents and also executed certain loan documents. Since the entire loan amount is settled, appellants would be entitled to receive back the relevant documents, notwithstanding the fact that those documents were marked on the side of the respondent/TIIC. The learned Counsel for the appellants is directed to file memo, mentioning the relevant documents, after giving notice to the respondents counsel. On such Memo being filed, High Court Registry is directed to return the relevant documents to the appellants.
