Judgment Ashok Parihar, J.-After hearing Counsel for the petitioner, I have carefully gone through the material on record. As per Ordinance of the University, the PHD Degree can only be granted for a piece of research work characterized either by the discovery of new facts or by a fresh interpretation of facts and theories. In either case it should reflect the candidates capacity for critical examination and Judgment . It should also be satisfactory as far as its literary presentation is concerned. In the present case, as per report of the research wing, the thesis submitted by the petitioner was not the original work and as has been observed in the order dated 28.07.2005 the same has been copied almost word by word from two earlier research works done by the respective candidates. Since it is purely subjective discretion of the academic experts, no interference whatsoever is called for by this Court in such academic matters under writ jurisdiction. 2. The writ petition is dismissed accordingly as having no merits.
