ORDER I. "The withholding of placement in the promotion panel for a year during the currency of punishment by stoppage of increment for three years without cumulative effect does not amount to double jeopardy." II. "An employee has no right to promotion but has only a right to be considered for promotion which depends upon his unblemished record for ensuring a clean and efficient administration in public interest. An employee found guilty of miscounduct cannot be placed on par with the other employees and his case has to be treated differently. A denial of promotion in such circumstances is not a penalty but a necessary consequence of his conduct." This order was made by S. MANIKUMAR, J. Writ petition dismissed.
