Judgment Satish Kumar Mittal, J. 1. Petitioner Gurmeet Singh alias Kala has filed this petition under Section 439 of the Code of Criminal Procedure for the grant of regular bail in case FIR No. 221 dated 8.8.2006 under Sections 364, 384, 383, 148, 149 IPC and Section 25/27 of the Arms Act, registered at Police Station Barnala, District Barnala. 2. I have heard counsel for the parties and gone through the contents of the FIR as well as the order dated 19.1.2007, passed by Additional Sessions Judge, Barnala, whereby bail application of the petitioner has been dismissed. 3. In this case, allegation against the petitioner is that when Harbans Singh complainant along with Karamjit Singh alias Bitta was present in the court premises at Barnala to attend the court proceedings, the petitioner with the help of his companions attempted to kidnap him. Counsel for the petitioner contends that the allegations in the FIR are totally false. He further contends that the other party fired from the pistol, which hit the petitioner and even no case has been registered against the other side. 4. Counsel for the petitioner further contends that as per the allegations, the petitioner made an attempt to kidnap the complainant, but he could not be kidnapped. Counsel further submits that the petitioner is in custody since 27.11.2006 and only challan has been filed, therefore, the conclusion of trial is not likely to conclude soon. The material facts have not been disputed by the State Counsel. 5. Keeping in view the aforesaid facts, without expressing any opinion on the merits of the case, I deem it appropriate to grant regular bail to the petitioner and he is, accordingly, ordered to be released on bail subject to his furnishing bail bonds to the satisfaction of the trial court.
