Judgment M.M.Aggarwal, J. 1. This is petition for grant of regular bail. Case is for the offence under Section 15 of the NDPS Act. 2. As per prosecution version, present petitioner and one Sher Singh were coming on one Maruti car, which was stopped by the police party but accused had run away. Five bags of poppy husk, each containing 40 kg poppy husk, were recovered from that car. Thereafter, Sher Singh was apprehended in some other case. He had disclosed about the involvement of the present petitioner Hari Singh to be with him in the present case of recovery. 3. Counsel for the petitioner points out that the petitioner was not arrested at the spot and that he has been falsely involved just at the instance of Sher Singh. 4. On behalf of the State, petition is opposed on the ground that recovery in this case is heavy and the present petitioner had run away and could be arrested only on 23.5.2006. 5. After hearing counsel for the parties, it is directed that the trial Court shall hold expeditious trial of the case. If the trial is not concluded within a period of six months from the next date fixed by the trial Court for no fault of the petitioner then the petitioner shall be released on bail by the trial Court to its satisfaction. With this observation, petition stands disposed of.
