ORDER Heard. This is the 2nd bail application for releasing the accused/applicant on regular bail. The earlier bail application was rejected on 29-1-2007. The accused/applicant is facing trial for commission of offence under Section 302 of the I.P.C. in Crime No. 96/2006, P.S. Suhela, District Raipur in connection with murder of Dukhuram. The case of the prosecution is that the accused/applicant took a loan of Rs. 30,000/- from Dukhuram. When Dukhuram demanded his money back from the accused/applicant, he threatened him of dire consequences. On 12-9-2006, Dukhuram left his house saying that he is going to the accused/applicant as he has called him to return money. On the same day, Janakram, Hemlal and Tukeshwar saw the deceased with the accused/applicant on motorcycle at about 8.30 p.m. when the accused was taking him towards Tilda. On 14-9-2006, the dead body of the deceased was found in the field at village Parsadeeh, Nevarikhar. Now, all the 3 witnesses have been examined by the trial Court and they have not supported the prosecution case. There is no other material evidence. Therefore, I am of the considered opinion that it is a fit case in which the accused/ applicant should be admitted to bail. Accordingly, the application is allowed. The accused/applicant is directed to be released on bail on his executing a personal bond in the sum of Rs. 10,000/- with a surety in the like sum to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court. However, the trial Court is directed to decide the main trial on its own merit, without being influenced by any of the observations made in this order. Bail Granted.
