JUDGMENT Rekha Sharma, J. (Oral)-Vide order dated 1st November, 2000 passed in ID 174/97, Presiding Officer, Labour Court No.1 directed reinstatement of the petitioner with continuity of service and full back wages. The said award was passed in the absence of M/S. R.K. Printers with whom the petitioner was employed. It appears that M/s. R.K. Printers on coming to know of the award, moved the Labour Court for setting aside of the same. The Labour Court by a subsequent order dated 26th March, 2003 set aside the award dated 1.11.2000. This time it was the petitioner workman who was proceeded against ex parte. Feeling aggrieved by the order dated 26th March, 2003, the petitioner has preferred the present writ petition. 2. It is submitted by learned Counsel for the petitioner that the petitioner never received any notice of the application moved by M/s. R.K. Printers for setting aside of the award passed in his favour dated 1.11.2000. Although, respondent has tiled on record counter affidavit to the writ petition but, none has appeared for the respondent thereafter. Today also none is present for the respondent. 3. In the above facts and circumstances of the case, I am of the view that the order dated 26th March, 2003 deserves to be set aside and as a consequence. the case is liable to be remanded back to the Labour Court No. 1 to consider the application of M/s. R.K. Printers for setting aside of the ex-parte award dated 1.11.2000 after giving proper notice to both the parties and allowing them to lead evidence, if any, in support of their respective case on that application. 4. With these directions, the writ petition stands disposed of. Writ Petition disposed of.
