Judgment :- In C.M.P.No.16309 of 2004 in C.M.P.No.7319 of 2004 in C.R.P.(NPD) No.938 of 2004, this Court, on 12. 2004, had directed the petitioner to deposit a sum of Rs.50,000/-(Rupees Fifty Thousand only) within a period of two weeks from the date of receipt of the order, failing which the Civil Revision Petition itself would stand dismissed without any further reference to this Court and if the amount was deposited as directed by this Court within two weeks, the respondent was permitted to withdraw 50% of the amount so deposited without furnishing any security and the petition was disposed of accordingly. 2. The petitioner filed C.M.P.No.7319 of 2004 in C.R.P.(NPD) No.938 of 2004, praying for staying all further proceedings pursuant to the order dated 11. 2003 in E.P.No.140 of 2000 in L.A.O.P.No.5 of 1998 on the file of the Principal Sub Court, Mayiladuthurai pending disposal of the above Civil Revision Petition. On 24. 2004, this Court had granted interim stay subject to the petitioner depositing a sum of Rs.25,000/- (Rupees Twentyfive Thousand only) to the credit of E.P.No.140 of 2000 in L.A.O.P.No.5 of 1998 on the file of the Principal Subordinate Judge, Mayiladuthurai, within two weeks from the date of receipt of a copy of the order, failing which the stay would stand automatically vacated. 3. Another C.M.P.No.13142 of 2004 in C.R.P.(NPD) No.938 of 2004 was filed by the petitioner praying for extension of time to comply with the order passed by this Court in C.M.P.No.7319 of 2004 in C.R.P.(NPD) No.938 of 2004 dated 24. 2004 by another eight weeks from the date of order of extension of time petition by condoning the delay of 25 days in filing the extension of time petition, in which this Court had passed an order on 18. 2004 granting six weeks time to comply with the order of this Court dated 24. 2004 made in C.M.P.No.7319 of 2004 in C.R.P.(NPD) No.938 of 2004. In spite of the extension of time granted by this Court, no deposit was made. 4. It appears that originally A.S.No.398 of 2002 and later renumbered as A.S.No.628 of 2002 was filed by the revision petitioner/appellant before this Court. In C.M.P.No.8984 of 2002, an interim stay was granted by this Court on 27. In spite of the extension of time granted by this Court, no deposit was made. 4. On 212. 2005, an interim stay of execution of the decree was granted by this Court. 5. In view of the factual scenario presented supra, this Court is of the considered view that the order passed by this Court in C.M.P.No.16309 of 2004 in C.M.P.No.7319 of 2004 in C.R.P.(NPD) No.938 of 2004, dated 12. 2004, which is a self contained one, has worked out now and therefore no further orders are necessary and accordingly, the Civil Revision Petition is ordered. However, there shall be no order as to costs. Consequently, connected C.M.P.No.7319 of 2004 is closed.
