JUDGMENT Rekha Sharma, J. (Oral)- This writ petition by Shri Shyam Sunder has been filed seeking a writ of prohibition against the respondent from taking any action towards revocation or cancellation of his promotion to the post of Lower Division Clerk in the Oil Industry Development Board. 2. It appears that when the petitioner tiled the writ petition, he was under an apprehension that he could be reverted by the respondent to his original post of a peon. The basis of such apprehension was one Shri Om Prakash who was claiming seniority over him. 3. It is stated in the counter affidavit filed by the respondent that a meeting of the Review DPC was held in March, 2006 to consider the claim of Shri Om Prakash to the post of Lower Division Clerk. The DPC after reviewing the position, recommended that the "promotion of Shri Shyam Sunder was in order. As such there is no affect on the promotion of Shri Shyam Sunder to the post of LDC". 4. In view of the aforesaid stand of the respondent. nothing survives in the writ petition. The same is, therefore, disposed of with the observation that if at any time in future any action of reversion is contemplated against the petitioner, the respondent shall take recourse to due procedure as per the Rules. CM No. 5333/06: 5. None is present to press this application. In any case, the writ petition has been disposed of. The application is dismissed for non-prosecution. CM No. 14814/05: 6. This application has become infructuous. The same is dismissed as such. Writ Petition disposed of.
